Please read the following important terms and conditions before you purchase a VIP membership and check that they contain everything you want and nothing that you are not willing to agree to.

This contract sets out your legal rights and responsibilities; our legal rights and responsibilities; and certain key information required by law.

In this contract ‘we’, ‘us’ or ‘our’ means  Triyit Ltd, a company incorporated in Scotland (Company Number SC538503) with a Registered Office at 3/4 Brook Street Studios, 60 Brook Street, Glasgow, Scotland, G40 2AB (Registered VAT Number 291117220); and ‘you’ or ‘your’ means the person using our site to buy goods from us.

1                   Introduction

1.1               We provide an 12 month membership which registers you as a Triyit VIP Member and entitles you to receive priority for all Triyit campaign matchmaking - the selection process for Triyit boxes - containing products for you to try and provide feedback on.

1.2               As a Triyit VIP Member, you must still meet the basic matchmaking criteria for any Triyit campaign in order to receive a Triyit Box. This ensures you receive products relevant to your profile and the criteria set by participating brand partners is achieved.

1.3               Triyit VIP Members must still fully complete the campaign feedback surveys for any campaigns and products they receive from a Triyit Box, in order to remain eligible for future Triyit campaigns.

1.4               This contract is only available in English. No other languages will apply to this contract.

1.5               When registering as a Triyit VIP Member you also agree to be legally bound by:

1.5.1          the Triyit website terms and conditions;

1.5.2          extra terms which may add to, or replace some of, this contract. We will contact you to let you know if we intend to do this by giving you 14 days’ notice (other than changes made for changes to the law, which will immediately become effective); and

1.5.3          specific terms which apply to certain goods. If you want to see these specific terms, please visit the relevant webpage for the goods at any time during the online checkout process.

2                   Information we give you

2.1               By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that we must give you certain key information before a legally binding contract between you and us is made. If you want to see this key information, please:       

2.1.1          read the key information within the VIP membership sign up form (hosted on typeform); or

2.1.2          contact us using the contact details at the top of this page.

2.2               The key information we give you by law forms part of this contract (as though it is set out in full here).

2.3               If we have to change any key information once a legally binding contract between you and us is made, we can only do this if you agree to it.

3                   Your privacy and personal information

3.1               Our Privacy Policy is available at [https://triyit.co.uk/terms-and-conditions].

3.2               Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

4                   Buying a VIP membership

4.1               Below, we set out how a legally binding contract between you and us is made.

4.2               You sign up to be a Triyit VIP Membership and make the payment for the 12 month VIP membership. Please read and check your order details carefully before completing the form submission and making the payment. You will be able to correct any errors after submitting your order to us. It is important that you provide us with the correct information.

4.3               When you place your order at the end of the online checkout process we will acknowledge it by email. This acknowledgement does not, however, mean that your Triyit VIP membership has been accepted by us.

4.4               We may contact you to say that we do not accept your order. This is typically for the following reasons:

4.4.1          we cannot authorise your payment;

4.4.2          you are not allowed to buy the Triyit VIP Membership from us;

4.4.3          we are not allowed to sell the Triyit VIP Membership to you; or

4.4.4          there has been a mistake on the pricing or description of the Triyit VIP Membership.

4.5               We will only accept your VIP membership when we email you to confirm this (“Confirmation Email”). At this point, a legally binding contract will be in place between you and us in relation to the 12 month Triyit VIP Membership. Any Confirmation Email will confirm both the price for the 12 month Triyit VIP Membership.

4.6               If you are under the age of 18 you may not subscribe for Triyit VIP Membership from the site.

4.7               At the end of the Term, we will send you an email with the option to renew for a further 12 month period and confirm the renewal cost to you. There will be no automatic renewal.

5                   Right to cancel

5.1               You have the right to cancel this contract at any time without giving any reason by clicking ‘delete your Triyit account’ on the footer of any Triyit email or by sending an email to: help@triyit.co.uk with the subject heading ‘Leave the club’. Please also give your name and contact number to verify your decision to terminate your account.

5.2               To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (eg a letter sent by post or email) using the contact details at the top of this page.

5.3               We have the right to terminate any contract with you should you breach any of these terms, our website terms and conditions or our Privacy Policy for any reason without having to provide any notice period.

6                   Effects of cancellation and refunds

6.1               If you cancel this contract within 14 days of the Confirmation Email (“14 Day Period”), we will reimburse to you all payments received from you. If you cancel this contract after the 14 Day Period, then no fees shall be reimbursed to you.

6.2               For any cancellation received within the 14 Day Period, we will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract.

6.3               We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

6.4               If during the 12 month VIP membership term, you have not received any Triyit Boxes from us, then within 30 days from the end of the Term we will reimburse to you the full VIP membership cost.

6.5               Should we terminate this contract in accordance with term 5.3 above;

6.5.1          If you have not received any Triyit Boxes from us during the relevant Term, then we will reimburse you fully for The Triyit VIP membership payment received from you during that Term; or

6.5.2          If you have received a Triyit Box from us during the relevant Term, then you will not be reimbursed.

7                   Delivery

7.1               We use third party delivery services to deliver our Triyit Boxes (“Delivery Service”).

7.2               The estimated date for delivery of any Triyit Box shall be set out in an email or text message from us to you, with an approximate delivery timeframe.

7.4               Delivery will take place at the address specified by you when you confirm your participation on the Triyit campaign - via the “confirm my details” form.

7.5               If nobody is available to take delivery, please contact the designated campaign courier

7.6               We can deliver only to the mainland UK and Northern Ireland, but are unfortunately not able to offer our Services to those living on the Channel Islands, Isle of Man, remote locations or internationally outside of the mainland UK and Northern Ireland.

8                   Payment

8.1               You shall make payment at the time of placing your order for the 12 month Triyit VIP membership.

8.2               Payment processing services on the site are provided by Stripe Payments Europe, Ltd trading as Stripe ("Stripe") and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement – United Kingdom (together, the "Stripe Terms"). By agreeing to these Terms or continuing to register as on the site, you agree to be bound by the Stripe Terms, as the same may be modified or amended by Stripe from time to time; and you agree to provide us with accurate and complete information about you and authorises us to share with Stripe such information and transaction information related to your use of the payment processing services provided by Stripe as we consider appropriate.

8.3               Nothing in this clause affects your legal rights to cancel the contract during the cancellation period as set out in clauses 5 and 6.

8.4               All prices are in pounds sterling (£)(GBP) and include VAT at the applicable rate, and include delivery charges.

9                   End of the contract

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

10                Limitation on our liability

10.1            Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury arising from negligence) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

10.1.1        losses that were not foreseeable to you and us when the contract was formed;

10.1.2        losses that were not caused by any breach on our part;

10.1.3        losses that were caused by any use of any goods other than in accordance with the instructions provided on or within any goods provided;

10.1.4        business losses; or

10.1.5        losses to non-consumers.

10.2            We shall not be held liable for any injury, loss or damage as a result of any use or misuse of a product supplied in a Triyit Box or allergic reaction which you might suffer as a result of a product supplied in a Triyit Box. It is for you to be aware of the contents of any products supplied and to take the necessary precautions to ensure that they are safe and that products are used in a safe and sensible manner.

11                Third party rights

No one other than a party to this contract has any right to enforce any term of this contract.

12                Disputes

12.1            We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with any part of the Triyit VIP Membership then please contact us as soon as possible using the contact details set out at the top of this page.

12.2            The laws of Scotland apply to this contract, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.

12.3            Any disputes will be subject to the jurisdiction of the courts of Scotland.
