Triyit is a product discovery club that enables its members to discover a tailored selection of products, at home for free.
On choosing to join the club, you are agreeing to Triyit's Terms & Conditions, which are set out below. If you find you do not agree with all of our terms and conditions, please do not join the club or use our site.
Terms & Conditions
Triyit Ltd Website Terms and Conditions will be referred to as ‘Terms’ for the remainder of this document.
This Website is owned and operated by TRIYIT LTD, a company incorporated in Scotland (Company Number SC538503) with a Registered Office at 3/1, 84 Miller Street, Glasgow, G1 1DT (Triyit). We can be contacted at hello@triyit.co.uk.
For the purposes of these Terms, "we" and "us" shall refer to Triyit Ltd and "you" shall refer to you, the Club Member or site visitor.
The service offered by Triyit is a product discovery club that allows Club Members to discover products at home for free, either digitally via the Triyit website or by receiving physical products, in return for feedback and/or reviews of that product.
Your access to and use of this Website and the products and services available through the Website are subject to the following Terms, which we may update from time to time.
1. Your acceptance
(a) These are the terms on which Triyit allows users both access and use of the Triyit website www.triyit.co.uk (Website) including access to the services and functionality made available through the Website, ability to view Content provided by Triyit and third parties, communicating with Triyit and reviewing product and service information.
(b) You accept these terms and agree to be bound by them when you:
(i) use, browse or access any part of the Website; or
(ii) register as a Club Member on the Website.
(c) If you are not in agreement with these Terms, you should immediately desist from using this Website as your continued use and access is not permitted.
(d) Triyit may review and update these Terms at any time without notice, to react appropriately to revisions in regulations, changes to legislation, new products, advances in technology, and for any other purpose. As your continued use of the Website will always be governed by the most up to date Terms posted on the Website, you are responsible for checking the Website regularly for the current version of the Terms. If you continue to use the Website, you are agreeing to be bound by the most recent Terms.
(e) Although the best efforts will be made to monitor and review the terms on a regular basis, they may contain errors.
2. Club Member Registration
(a) Interested users may access and browse our Website but to take advantage of the products and services offered, you will need to join the club by registering your details at www.triyit.co.uk/join. We will only ask you for your name, email address and for you to confirm that you are both over the age of 18 and resident in the United Kingdom at this stage and to confirm that you are a human before you can start setting up your account. The information which you provide at this initial stage is processed in line with these Terms regardless of whether you go on to complete your Profile.
(b) Only those aged 18 years or over are permitted to join the club and register on the Website.
(c) You warrant that all of the information submitted by you during the registration process, and when you are setting up your Profile, is current, accurate and complete. You will notify us promptly, of any change to the information or data you have provided.
(d) Should your account be accessed or used in an unauthorised manner you must make us aware of this without delay. You will take full responsibility for all acts and omissions of any other party using your account and these acts and omissions will be deemed to be your own. We will not be liable, under any circumstances, for any costs, expenses, damages, losses or claims of any type, which results from the use/misuse of your account and you, will be required to indemnify us against all costs, expenses, damages, losses, claims, or demands, should this situation arise. Furthermore, if club members have been found to create multiple profiles in an attempt to dishonestly receive Triyit boxes, we have the unreserved right to remove all profiles of the individual.
(e) Once you have completed your registration, we will ask that you set up your profile. This involves giving Us personal information about various aspects of your home and personal life which We will then use to match you with products based on the demographic market that our partners are trying to reach (Profile). We handle your data in accordance with the relevant regulations governing data protection, discussed below.
3. Triyit Services
(a) We partner with a number of products and brands who are keen to have your feedback and support. By signing up and registering as a Club Member you tell us a little about yourself and your interests, building a Triyit Profile. Users may browse products on our platform which may be relevant to the profile information they submitted. When a physical campaign pops up that matches your Profile, a Triyit Box of campaign products will be delivered straight to your home for free. In the event that the number of matching profiles exceeds the number of Triyit Boxes available, priority may be given to Club Members with the most rewards/stars earned. The remainder will be allocated by ballot (Services).
(b) Our product discovery club is free for you to register and use. In return for receiving a Triyit box, we ask that you complete a feedback survey telling us what you thought about the products and/or service offers you received. Completing the feedback survey maintains your eligibility for future campaigns.
The time limit for completing a feedback survey will be different for each campaign. It is for our Members to be aware of the time limits in which they need to provide feedback for that campaign. Any Member who does not provide feedback within the designated time limit tfor a campaign will have their membership with Triyit terminated immediately on the date following the deadline date.
(c) Registering with Triyit does not guarantee that Club Members will receive a Triyit Box. The matching of Club Member profiles with product campaigns is entirely at the discretion of Triyit.
(d) For each campaign, we will only be able to offer products to those Members who match with all the Profile criteria that our Brand Partner is looking for.
(e) We offer free shipping anywhere within the mainland UK and Northern Ireland, but are unfortunately not able to offer our Services to those living on the Channel Islands, Isle of Man, remote locations or internationally outside of the mainland UK and Northern Ireland.
(f) We will only provide our Services to those Members who adhere to our Code of Conduct and it is at our total discretion which of our Members will receive products as part of our campaigns.
(g) We aim to make sure that our Services are provided in a consistent and uninterrupted manner. However, we cannot take any responsibility for events outside of our control. Our provisions regarding access to the Website and your access to it can be found at Section 8.
(h) Before sending out campaign boxes to those members who have been selected to take part, We will require Members to provide additional personal information. We will ask club members to confirm their address, mobile phone number, and occasionally age verification or additional questions relevant to the campaign, which may further help in the matching process. The information collected during this 2nd stage process will be held in accordance with the terms of our Privacy Policy. More information about our Privacy Policy can be found below at clause 9.
4. Product information and availability
(a) The listing of any particular product or service on our Website is for information and research purposes only. Triyit does not warrant, make any representations, or guarantee the condition, quality or description in relation to any products or services you may receive as part of a Triyit product campaign.
(b) We are not responsible or liable for any loss or damage you or any third party may suffer or incur in connection with any product or service you receive after using this Website or for any acts, omissions, errors or defaults of any third party in connection with that product or service.
(c) Triyit Boxes are delivered on our behalf by third party carriers. Whilst we take all reasonable steps to ensure Triyit Boxes are correctly labelled, packed and delivered, we take no responsibility for any Triyit Boxes which are not properly labelled, delivered correctly or which contain damaged or missing goods. We do not offer a returns or exchange option for any Triyit Box deliveries. Members who have received products which have been damaged during their delivery are still bound by the Code of Conduct and are expected to submit feedback for that product.
(d) Whilst every effort is made to ensure the information provided on the Website is current, we have no responsibility or liability for any errors contained in the information. Inclusion of any product or service information on this Website is not an endorsement of any organisation, product or service.
(e) Triyit has the right, but not the obligation, to monitor any information, comment, content, communication, advice, text, or other material (Content) made available by any Member on the Website. Triyit reserves the right, in its absolute discretion, to block, modify or remove any Content contained on the Website without prior notice, and will not be liable in any way for possible consequences of such actions.
(f) Triyit are not responsible for any adverse effects that results from a product you receive in a Triyit box. Further information can be found in section 14(e).
(g) Any product, service, coupon or voucher offered by us, or any partners, is not intended for resale. Any violation (as determined solely by us) of this provision by a Club Member may result in removal from the campaign and/or termination of club membership
5. Communications
(a) Service Communications
In order to provide the Services to Members, Triyit will send email and sms messages to club members to confirm selection for a campaign, to confirm delivery details, to remind them of important campaign activities, feedback, SNAP – SHARE – WIN activities, coupon expiry dates, and any other message which relates to the practicalities of the Triyit Services.
By agreeing to these Terms, you are consenting to Triyit sending you these messages to fulfil our obligations under the Services.
(b) Marketing Communications
As a result of the relationship between Triyit and our brand partners, from time to time, we may wish to send you messages with exclusive offers and discounts on the many products that your profile indicates you’ll enjoy.
We require your consent to send you such marketing messages and will ask if you wish to receive these when you sign up as a Member. If you no longer wish to receive these marketing messages you can change your communications preferences at any time by clicking the “Unsubscribe” link at the bottom of our marketing emails or by contacting us directly using the contact information at clause 20 below.
6. Sweepstakes
For the purposes of this clause 6, Triyit Limited shall be referred to as the “Promoter”.
From time to time, as part of a campaign, a sweepstake competition will run in connection with that campaign. Entrants will be invited to post pictures on their relevant social media channels using the hashtags indicated by the information included with the campaign box to win prizes including supplies of the featured brand.
Entry Requirements: Entrants must be 18 years of age or over and reside in the United Kingdom. Entrants agree to participate in all reasonable promotional activities as requested by the Promoter unless otherwise notified to the contrary at the time of acceptance of the Prize. By entering this Promotion, entrants grant to the Promoter and the featured brand, a non-exclusive, perpetual, worldwide, royalty free, transferable license to use and re-purpose any material submitted as part of their entry and their participation in the Promotion for the purposes of conducting and promoting this Promotion and for the purpose of advertising and marketing the Promoter, on all media now known or later devised.
Any materials submitted by the winning entrant as part of this Promotion must be original, accurate, unaltered and the entrants own work. Entrants who breach this clause may be deemed ineligible. Any submissions by the winning entrant may be modified, altered or deleted by the Promoter in its absolute discretion. To be eligible to win a prize in this Competition: an Entry must not:
(a) Contain images of children under the age of 16;
(b) infringe the intellectual property or other rights of a third party;
(c) be incomplete or illegible; or
(d) be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in the Promoter’s sole discretion, is inappropriate or objectionable.
The promoter accepts no responsibility accepted for late, lost or misdirected entries. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
Each valid entry will be individually judged (by representatives of the Promoter and/or the featured brand). In the event of when the representatives of the Promoter and/or feature brands decide not to select the winners themselves, a shortlist of their top-rated entries will be posted on Triyit social media pages and the Triyit community members will be asked to cast their votes for their favourite entries.
Each Prize is not transferable and not redeemable for cash or other goods or services. Each Prize must be taken as a whole and as stated in the terms included with that specific campaign. No alternative will be provided. Each prize is to be used for personal use only and not to be re-sold or used for business or corporate purposes. If an Entrant’s contact details changes between the date of entry and the Unclaimed Prize Determination, the Entrant must notify the Promoter of his/her updated contact details. Each Winner participates in this Competition, and uses the Prize, at his or her own risk. All and any submissions made should include the hashtag “#Triyit”.
Notification of Winners:
The winners announcements will take place at the end of the campaign via the Triyit UK social channels (Facebook and Instagram). If the winners have not contacted Triyit UK to claim their prize within 28 days of announcement, then another winner may be selected.
Prize Delivery:
The Prize will be delivered to the winner by the Promoter and/or featured brand.
Facebook, Instagram, and Twitter: This promotion is in no way sponsored, endorsed or administered by, or associated any social media channels which may host entries. All entries must adhere to the terms and conditions of the social media channels on which entries are posted.
By posting content to our site or any third party sites as part of a Triyit campaign, promotion or competition, you represent that you own or have the right to use all of the content and information you post. Although you will continue to own your content (unless stated otherwise in the terms of any third party site used), when you publish content as described, you agree that you are allowing us and our clients to access and use that content & information.
For content that is covered by intellectual property rights (like photos and videos) you grant us a non-exclusive, sub-licensable, royalty-free, worldwide license to use this content in connection with current & future Triyit campaigns/marketing and our client’s (brand partners) own marketing communications. For example, our client could create an ad using content that you have placed/posted as part of a Triyit campaign, promotion or competition. You are not entitled to any compensation or reimbursement of any kind from us or any of our clients under any circumstances.
7. Links
(a) The Website may contain links to other web sites. Triyit provides those links as a ready reference for searching for third party goods and services on the internet and not as an endorsement of those web sites, their operators, the goods, services or content that they describe.
(b) Other web sites which are linked to the Triyit Website are not covered by these Terms, and may have their own terms and conditions and privacy policy. If you choose to access these linked sites, this is done completely at your own risk. Triyit does not take any responsibility for and will not be liable in respect of the content or operation of any other web sites or any of the goods, services or content that they describe. Triyit is not responsible for and will not be liable in respect of any incorrect link to an external web site.
(c) You are not permitted to frame or link the Triyit Website without first requesting and obtaining express written permission from Triyit.
8. Access
(a) Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit does not warrant that you will have continuous access to the Website. Triyit will not be liable in the event that your use of this Website is disrupted or prevented due to computer downtime attributable to malfunctions, upgrades, preventative or remedial maintenance activities or interruption in the supply of telecommunications. Triyit does not guarantee that any such technical issues that might arise can be resolved quickly.
(b) Triyit does not guarantee the delivery of communications over the internet as such communications are reliant on services provided by third parties. Electronic communication (including electronic mail) is vulnerable to interception by third parties and Triyit does not guarantee either the security or the confidentiality of these communications or the security of the Website.
(c) Triyit does not provide, and has no control over, communications, networks or services, the internet or other technology required or used across the Website and accepts no responsibility for any direct or indirect loss in any form associated with them, whether due to congestion, technical malfunction, viruses or any other circumstances.
(d) Information contained on the Website relating to goods and services has been prepared in accordance with UK law and may not satisfy the laws of another country. Triyit does not warrant that:
(i) the goods or services available on this Website; or
(ii) the Website and its Content, comply with the laws of any other country. You are responsible for determining whether or not the goods or services comply with the specific laws of your jurisdiction.
(e) those who access and/or use this Website or its content from outside of the UK or who transact on this Website, do so at their own risk.
9. Privacy
Any personal information which you submit to Triyit is subject to and will be handled in accordance with Triyit’s privacy policy (Privacy Policy). The Privacy Policy forms part of these Terms and is set out at www.triyit.co.uk/privacy You agree that, by using the Website or communicating with Triyit, you are also confirming that you have read the Privacy Policy, understood its contents and consented to its requirements.
10. Intellectual property rights
(a) All intellectual property rights, including copyright (both registered and unregistered) and patents, in the Website, Triyit’s goods and services, and all components of them are owned or licensed by Triyit and/or any of its related entities. Copying, modifying or transmitting any part of the Website is not permitted.
(b) The Website contains trademarks, logos, service names and trade names of Triyit (and third parties) which may be registered or otherwise protected under the law. You are not permitted to use any of these trademarks, logos, service names, trade names or any other content or copies of the content appearing on the Website.
11. Website licence and use
Triyit grants you a non-exclusive and non-transferable licence to use the Website for your own personal use, subject to the restrictions specified in clause 12 below. You are not authorised to download (other than page caching) or modify the Website or any portion of the Website. You agree that any Content which you choose to post on the Website or otherwise provide or communicate to Triyit, will be treated as non-confidential and non-proprietary information.
12. Prohibited uses
(a) Except as otherwise expressly permitted in using the Website you must not:
(i) engage in any commercial activity including marketing, advertising or commercial promotion of goods or services, resale, collect or use any product lists or information for the benefit of other merchants, data mine or use robots or other data collection methods;
(ii) impersonate or falsely claim to be a representative of a person or organisation;
(iii) defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including without limitation, rights associated with privacy and publicity;
(iv) post, link to, or otherwise communicate or distribute any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material, content or information, or otherwise use the Website in a manner which is unlawful or would infringe on the rights of another person including any intellectual property rights;
(v) post, link to, or otherwise distribute any information, material or item which contains a virus, trojan horse, worm or other harmful or disruptive component.
(b) Unauthorised use of the Website may give rise to a claim for damages and/or may result in legal proceedings being taken against you.
(c) Triyit provides no warranties and cannot guarantee that any file, program, access or use of the Website is free from viruses, malware or other harmful technology or material which could damage or infect your data, hardware, software or other equipment. By accessing and using the Website you assume all risk in this regard and you release Triyit Ltd from all applicable liability and responsibility.
13. Termination
Triyit may at any time immediately terminate your access (including restricting access) to the Website or any feature of the Website for any reason (including due to your breach or alleged breach of these Terms or our club’s code of conduct) in its sole discretion and without prior notice. Any indemnities given by you and any limitations of our liability survive such termination.
You may terminate your participation as a member of Triyit at any time, for any reason, by sending an email to: hello@triyit.co.uk with the subject heading ‘Leave the club’. Please also give your name and contact number to verify your decision to terminate your account.
If you choose to terminate your membership after receiving a Triyit box and without having submitted your campaign feedback, your details and account will be blacklisted, meaning you will not be able to re-join the club in the future. Furthermore, no one else living at the same address will be able to join.
Our agreement with you under these Terms & Conditions is in full force and effect while you visit the sites and/or are a member of Triyit and continues to be so even after your participation ends or is terminated.
14. Disclaimer of warranties and limitation of liability
(a) To the full extent permitted by law, Triyit excludes all warranties, whether express or implied, including any warranties or representations concerning availability of the Website, quality, completeness, accuracy, suitability, acceptability or fitness for purpose in relation to the Website, the Content, the conduct of any users, all links to or from the Website and the goods and services listed or accessible on the Website.
(b) Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit excludes all liability for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with these Terms, the Website, the Content, and all links to or from the Website.
(c) Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit excludes all liability for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with the goods and services listed, accessible or made available on the Website.
(d) Triyit Members and site users are subject to our Code of Conduct at all times.
(e) Triyit shall not be held liable for any injury, loss or damage as a result of any use or misuse of a Product or allergic reaction which a Member might suffer as a result of a Product supplied as part of a campaign. It is for Members to be aware of the contents of campaign Products and to take the necessary precautions to ensure that they are safe and that Products are used in a safe and sensible manner
15. Indemnity
You agree to fully indemnify Triyit, its directors, officers, directors, employees, consultants, agents and affiliates in respect of all, costs, expenses (including legal fees on a full indemnity basis), losses, damages, fines, penalties, claims, demands and proceedings howsoever arising, whether at common law (including negligence) or under statute, in connection with any of the following:
(a) any breach of these Terms by you;
(b) your access or use of the Website;
(c) any products delivered in a Triyit Box or otherwise; or
(d) your communications with Triyit or any other third party.
16. Jurisdiction and law
These Terms are governed by and must be construed in accordance with the laws of Scotland. Any disputes arising as a result of these terms and conditions, their performance, and their interpretation shall be subject to the exclusive jurisdiction of the Scottish Courts.
17. Waiver
If you breach these conditions at any time and we decide to take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.
18. Severability
Each provision of these Terms is severable from the others and no severance of a provision will affect any other provision.
19. Entire Agreement
The above Terms constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Triyit. Any waiver of any provision of the Terms will be effective only if obtained in writing and signed by a Director of Triyit Ltd.

Triyit Ltd. ("Triyit", "we", "our", or "us") is committed to protecting your privacy and ensuring that your personal information is protected.
We have provided this Privacy Policy to inform you ("You" or "Your") how we gather and use, and the circumstances under which we may disclose, personal information we collect from our members ("Club Members") through www.triyit.co.uk (the "Site") in connection with our service (the "Service").

3. PRIVACY POLICY IS LIMITED TO TRIYIT
This Privacy Policy does not apply to third party sites to which we may link or to the products or services of our business partners such as the brands that we work with who provide product samples or third parties who may host and/or deliver our data to brands and other like services. The fact that we link to a website or display an advertisement or other third party content is not an endorsement, authorisation or representation of our affiliation with any of those third parties, nor is it an endorsement of their privacy or information security policies or practices.
4. COLLECTION AND USE OF NON-IDENTIFYING INFORMATION
We may collect, use, transfer, and disclose information in a form that does not personally identify you ("Non-Identifying Information") for any purpose. Non-Identifying Information can include certain personally identifiable information that has been de-identified; that is, information that has been rendered anonymous. We and/or our third party service providers obtain and may collect non-Identifying Information about you from information that you provide us and/or from your use of the Service, either separately or together with your Personal Information. As part of your use of our Site and as part of our Service to the brands we work with, we may ask you to submit feedback on certain products, by way of surveys, testimonials, ratings and reviews or other format. In order to uniquely identify you, and so that you may receive communications from us and use our Site, we may ask for the following:

- gender and
- any other personal information that we may require to fulfil our obligations ("Personal Information").
Our justification for collecting this information is that it is necessary for us to do so in order to fulfil our obligations to our Members under the contract between us contained in our Terms and Conditions.
If you decide to access the service or sign up via a third party social networking platform ("SNP"), such as Facebook, via our Service, we may also collect Personal Information when you interact with the service. If you log into an SNP via the Service, you are allowing Triyit to access the Personal Information in your SNP account, as well as other information associated with your SNP account, pursuant to the SNP's applicable terms and conditions. The information we receive from an SNP may depend on the privacy settings you have with the SNP, so please check the SNP's privacy policy.

6. USE OF PERSONAL INFORMATION
We may use your Personal Information, either alone or in combination with other information, so that we can provide, enhance and personalise our Service and related content, products, offers, and marketing efforts. The following is a non-exhaustive list of ways that we may use your Personal Information:
(a) to register and/or identify you as a user of the Service and to help authenticate any account you create with us;
(b) to match you with products, offers, and trials that best fit your likes and needs;
(c) to send you products or samples as part of a Triyit campaign;
(d) to communicate with you regarding campaigns, the Service, updates, offers, promotions or events and to deliver products to you for sampling (if you have provided your consent for us to use your information in this way);
(e) to help us develop, customise, deliver, support and improve our Service, products, samples, content, and advertising and to provide you with the best user experience possible;
(f) to administer promotions, contests, sweepstakes or other offerings;
(g) to protect the rights or property or security of Triyit or our users, and prevent fraud and other prohibited or illegal activities;

· Personal data may be transmitted over secure networks only, transmission over unsecured networks is not permitted in any circumstances;
· Personal data may not be transmitted over a wireless network if there is a wired alternative that is reasonably practicable;
· Personal data contained in the body of an email, whether sent or received, should be copied from the body of that email and stored securely. The email itself should be deleted. All temporary files associated therewith should also be deleted using permanent deletion of the email from trash;
· Where personal data is to be transferred in hardcopy form it should be passed directly to the recipient; and
· All personal data to be transferred physically, whether in hardcopy form or on removable electronic media shall be transferred in a suitable container marked “confidential”.
· No personal data may be shared informally and if an employee, agent, sub-contractor, or other party working on our behalf requires access to any personal data that they do not already have access to, such access should be formally requested from Dr Derek Connor (datateam@triyit.co.uk);
· No personal data may be transferred to any employees, agents, contractors, or other parties, whether such parties are working on our behalf or not, without the authorisation of Dr Derek Connor (datateam@triyit.co.uk);
· Personal data must be handled with care at all times and should not be left unattended or on view to unauthorised employees, agents, sub-contractors, or other parties at any time;
· If personal data is being viewed on a computer screen and the computer in question is to be left unattended for any period of time, the user must lock the computer and screen before leaving it; and
· Where personal data held by us is used for marketing purposes, it shall be the responsibility of Dr Derek Connor (datateam@triyit.co.uk) to ensure that the appropriate consent is obtained and that no data subjects have opted-out, whether directly or via a third-party service such as the TPS;
· All passwords used to protect personal data should be changed regularly and should not use words or phrases that can be easily guessed or otherwise compromised. All passwords must follow recognised industry bets practices. All software used by us is designed to require such passwords;
· Under no circumstances are passwords to be written down or shared between any employees, agents, contractors, or other parties working on our behalf, irrespective of seniority or department. If a password is forgotten, it must be reset using the applicable method. Our IT staff do not have access to passwords;
· All software (including, but not limited to, applications and operating systems) shall be kept up-to-date. Our IT staff shall be responsible for installing any and all security-related updates not more than six months after the updates are made available by the publisher or manufacturer;
· No software may be installed on any of our owned computers or devices without the prior approval of Dr Derek Connor (datateam@triyit.co.uk).
8. SHARING CAMPAIGN FEEDBACK & OTHER CONTENT
The information collected during the feedback/survey process is used to prepare statistical reports and analytics for our clients (brand partners). The reports give insight into the performance of the product during a campaign run on the client’s behalf. The Reports will not contain your personal information, unless you have specifically given permission to do so via an opt-in at the time you join a campaign or leave feedback.
By joining the club, you acknowledge and agree that: (a) we are not under any obligation of confidentiality (express or implied) with respect to your campaign/product feedback; (b) we and our clients can use or disclose (or choose not to use or disclose) your feedback for any purpose, in any way, in any media worldwide; and (d) you are not entitled to any compensation or reimbursement of any kind from us or any of our clients under any circumstances.
By posting content to our site or any third party sites as part of a Triyit campaign, promotion or competition, you represent that you own or have the right to use all of the content and information you post. Although you will continue to own your content (unless stated otherwise in the terms of any third party site used), when you publish content as described, you agree that you are allowing us and our clients to access and use that content & information. For content that is covered by intellectual property rights (like photos and videos) you grant us a non-exclusive, sub-licensable, royalty-free, worldwide license to use this content in connection with current & future Triyit campaigns/marketing and our client’s (brand partners) own marketing communications. For example, our client could create an ad using content that you have placed/posted as part of a Triyit campaign, promotion or competition. You are not entitled to any compensation or reimbursement of any kind from us or any of our clients under any circumstances.
You, and not us, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via Triyit and/or any of our product campaigns.
We do not have an obligation to review the content posted to our site, but you understand that we may refuse to post or remove any of your content at our sole discretion.
9. OUR SERVICE PROVIDERS
We may engage third parties to perform services on our behalf, such as hosting and storage services, software maintenance services, e-mail notifications, database management, analytics and other services. These third parties may have access to your Personal Information to perform certain tasks on our behalf but they are not authorised by us to otherwise use or disclose your Personal Information.
The service providers who we are currently engaged with are:
Typeform – platform used to record all consumer profiles and feedback completion data
Mailchimp – platform used as a proxy email server to send out mass emails to our members. Collects names, emails and IP addresses.
SendGrid - platform used as a proxy email server to send out mass emails to our members. Collects names, emails and IP addresses.
Google Cloud Platform – Cloud storage platform for all profiles and member data
Voodoo SMS – uses Member mobile phone numbers to send SMS messages during campaigns.
DPD (DPDGroupUK Limited) – are provided with club member’s names and addresses to facilitate package delivery.
Royal Mail – are provided with club member’s names and addresses to facilitate package delivery.
Whistl – are provided with club member’s names and addresses to facilitate package delivery.
EVRI (MyHermes) - are provided with club member’s names and addresses to facilitate package delivery.
In addition, if you voluntarily participate in a sweepstakes, contest, rewards program or other promotion through our Site or Service, we may share your Personal Information with the participating sponsors or with third parties who assist us in using the content or other information you have posted or shared with us.
Pre-Launch Profile information of users/members who join the club after 12/01/2024 may be held securely on Amazon Web Services (AWS).
10. OTHER GENERAL INFORMATION
(a) Public Posts on the Service
Any information that you voluntarily disclose for public posting to the Service becomes available to the public and may be seen or collected by other persons, including third parties that may not adhere to the standards set forth in this Privacy Policy. Do not submit information, comments, or other content that you want to keep strictly private. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Service.
(b) Changing or Deleting Your Information
To view and change Personal Information that you have directly provided to Triyit via the Service, you can contact Triyit by sending an email to hello@triyit.co.uk Information may also be accessible via the "account profile" section of our website. Please note we may retain server/backup copies of all such data, and that we may decline to process change or deletion requests that we deem to be unreasonable, or require disproportionate technical effort, or jeopardise the privacy of others.
(c) Compliance with Laws, Legal Process and Authorities
We may disclose Personal Information or other information about you to government or law enforcement officials, in connection with court orders or judicial process, to protect the property and rights of us or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable.
(d) Business Transfers
We reserve the right to transfer or otherwise disclose your Personal Information in connection with a merger, acquisition, or other change in control, joint venture, reorganisation or sale of assets or in the event of bankruptcy or liquidation proceeding.
(e) Data Transfers
Triyit processes Personal Information via 3rd party service providers. Your Personal Information may be transferred to, and used by, entities located outside of your country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Such export is a requirement of providing your information to Triyit, and you consent to such transfer and use in all respects.
(f) Our Policy Toward Children
We do not knowingly collect personally identifiable information from anyone under 18 and do not target our online services to anyone under 18. If we discover that someone under the age of 18 has provided Personal Information we will delete such information from our Site and server. We encourage parental controls to prevent children from submitting information or data on our Site.
11. HOW CAN YOU ACCESS YOUR PERSONAL DATA?
If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.
