TERMS & CONDITIONS

Triyit is a product discovery platform that enables its community members to discover a tailored selection of products, at home for free.

On choosing to join the platform and/or use our Website, Platform or Services, you are agreeing to Triyit's Terms & Conditions, which are set out below. If you find you do not agree with all of our terms and conditions, please do not join the platform or use our site.

Triyit Ltd Website Terms and Conditions will be referred to as ‘Terms’ for the remainder of this document.

This Website is owned and operated by TRIYIT LTD, a company incorporated in Scotland (Company Number SC538503) with a Registered Office at Suite 3/1 84 Miller Street, Glasgow, Scotland, G1 1DT (“Triyit”). We can be contacted at help@triyit.co.uk.

For the purposes of these Terms, "we", “our” and "us" shall refer to Triyit Ltd and "you" shall refer to you, the Community member or site visitor.

The service offered by Triyit is a product discovery platform that allows Community members to discover products at home for free, either digitally via the Triyit Website or by receiving physical products, in return for feedback and/or reviews of that product.

Triyit reserves the right to update, modify or vary these terms from time to time without notice to you.  By accessing and using the Website, registering on the Platform and/or making use of our Services, you acknowledge and agree that you have read and will comply with these Terms as updated or amended from time to time.

1 - DEFINITIONS

1.1 - In these Terms, the following words and expressions have the following meanings:

Brand Partner” means a third party service or product provider whose goods and/or services are made available through the Platform and/or Triyit Boxes;

Community member” means a site visitor who has registered their details as a member and created a Profile on the Platform;

Code of Conduct” means Triyit’s code of conduct accessed at https://triyit.co.uk/code-of-conduct as updated or amended from time to time;

Competition Terms” means Triyit’s terms and conditions for a relevant competition. A list of the available competitions and the terms applicable to each can be accessed at [URL];

Content” means any information, comment, communication, advice, text, graphic, image or other material made available on the Website or Platform;

Data Protection Laws” means:

(a) The UK General Data Protection Regulation (the “UK GDPR”);

(b) The Data Protection Act 2018;

(c) Any laws which implement or supplement any such laws; and

(d) Any laws that replace, extend, re-enact, consolidate or amend any of the foregoing;

Intellectual Property Rights” means copyright, rights related to copyright such as moral rights and performers rights, patents, rights in inventions, rights to use and protect the confidentiality of confidential information (including, but not limited to know-how and trade secrets), trade marks, service marks, trade names, design rights, rights in get-up and trade dress, database rights, databases, data exclusivity rights, approvals, domain names, business names, rights in computer software, the right to sue for infringement, unfair competition and passing off, all similar rights of whatever nature wherever in the world arising, in each case:

(a) Whether registered or not,

(b) Including any applications to protect or register such rights,

(c) Including all renewals and extensions of such rights or applications,

(d) Whether vested, contingent or future, and

(e) Wherever existing;

Personal Data” has the meaning given in applicable Data Protection Laws;

Platform” means Triyit Ltd’s online product discovery platform accessed through the Website;

Privacy Policy” means Triyit’s privacy policy accessed at https://triyit.co.uk/privacy as updated or amended from time to time;

Priority Points” means points which may be awarded to a Community member for completing activities on the Website, including but not limited to, participating in certain surveys, participating in campaigns, submitting reviews for goods received in Triyit Boxes and/or for participating in certain competitions;

Processing” has the meaning given in applicable Data Protection Laws and related expressions including process, processed and processes shall be construed accordingly;

Profile” means a user demographic profile on the Platform detailing information about the individual user and their consumer characteristics;

Triyit Box” means a box of goods provided to a Community member in connection with a Brand Partner campaign;

Triyit Tokens” means tokens which can be earned by a Community member to be redeemed towards a Triyit Box;

VIP Membership Terms” means Triyit’s terms and conditions for the purchase and use of a VIP Membership accessed at https://triyit.co.uk/vip-membership-terms-and-conditions;

Website” means Triyit Ltd’s website accessed at www.triyit.co.uk;

YOUR ACCEPTANCE

1.2 - These Terms are the conditions on which Triyit allows users both access and use of the Triyit Website and Platform including access to the services and functionality made available through the Website and/or Platform, ability to view Content provided by Triyit and third parties, communicating with Triyit and reviewing product and service information.

1.3 - You accept these terms and agree to be bound by them when you:

1.3.1 - Use, browse or access any part of the Website; and/or

1.3.2 - Register as a Community member on the Website.

1.4 - If you are not in agreement with these Terms, you should immediately desist from using this Website as your continued use and access is not permitted.

1.5 - Triyit may review and update these Terms at any time without notice, to react appropriately to revisions in regulations, changes to legislation, new products, advances in technology, and for any other purpose.   As your continued use of the Website and/or Platform will always be governed by the most up to date Terms posted on the Website, you are responsible for checking the Website regularly for the current version of the Terms.  If you continue to use the Website and/or Platform, you are agreeing to be bound by the most recent Terms.

1.6 - Although best efforts will be made to monitor and review these Terms on a regular basis, they may contain errors.

COMMUNITY MEMBER REGISTRATION

1.7 - Interested users may access and browse our Website but to take advantage of the products and services offered, you will need to join the Platform by registering your details at www.triyit.co.uk/join.  We will only ask you for your name, email address and for you to confirm that you are over the age of 18 and resident in the United Kingdom at this stage and to confirm that you are a human before you can start setting up your account.  Triyit reserves the right to undertake age verification on any person registering as a Community member and you may be required to provide valid proof of age to Triyit in order to verify you meet the minimum age requirement. The information which you provide at this initial stage is processed in line with these Terms regardless of whether you go on to complete your Profile.  Please note that when using the Platform we make use of reCAPTCHA to verify that you are a human and the use of reCAPTCHA is governed under our Privacy Policy.

1.8 - Only those aged 18 years or over are permitted to join the platform and register on the Website and/or Platform.  If Triyit discovers that anyone under the age of 18 has registered a Community member account, the relevant account will be removed by Triyit without liability to the person affected.

1.9 - You warrant that all of the information submitted by you during the registration process, and when you are setting up your Profile, is current, accurate and complete. You will notify us promptly, of any change to the information or data you have provided.

1.10 - Should your account be accessed or used in an unauthorised manner you must make us aware of this without delay. You will take full responsibility for all acts and omissions of any other party using your account and these acts and omissions will be deemed to be your own. We will not be liable, under any circumstances, for any costs, expenses, damages, losses or claims of any type, which results from the use/misuse of your account and you, will be required to indemnify us against all costs, expenses, damages, losses, claims, or demands, should this situation arise. Furthermore, if Community members have been found to create multiple profiles in an attempt to dishonestly receive Triyit boxes, we have the unreserved right to remove all Community member profiles of the individual without liability to the relevant Community member.

1.11 - Once you have completed your registration, you will be required to complete a number of mandatory surveys to set up your Profile. This involves giving Triyit personal information about various aspects of your home and personal life which We will then use to match you with products based on the demographic market that our partners are trying to reach. We handle your data in accordance with the relevant regulations governing data protection and our Privacy Policy, discussed below. Triyit will endeavour to remind you to complete the mandatory surveys if your Profile is incomplete.  If you do not complete the mandatory surveys required to complete your Profile within a reasonable period of time, Triyit reserves the right to remove your Community member account without liability to you.

1.12 - You may choose to pay to upgrade your membership to become a VIP Community member.  These Terms and Conditions continue to apply to your use of the Platform and Triyit’s services where you purchase a VIP upgrade, and are subject to the additional VIP Membership Terms.  For more information on payment, VIP benefits and the terms and conditions applicable to your VIP membership, please see the VIP Membership Terms accessed at https://triyit.co.uk/vip-membership-terms-and-conditions.  In the case of any conflict between these Terms and Conditions and the VIP Membership Terms, the VIP Membership Terms shall prevail to the extent of the conflict.

TRIYIT SERVICES

1.13 - We partner with a number of products and brands who are keen to have your feedback and support. By signing up and registering as a Community member you tell us a little about yourself and your interests, building a Triyit Profile. Users may browse products on our platform which may be relevant to the profile information they submitted. When a physical campaign pops up that matches your Profile, a Triyit Box of campaign products will be delivered to you for free (the  “Services”). In the event that the number of matching Profiles exceeds the number of Triyit Boxes available, priority may be given to Community members with the most Priority Points earned. The remainder will be allocated by ballot.

1.14 - Our Platform is free for you to register and use. In return for receiving a Triyit Box, you are required to complete a mandatory feedback survey telling us what you thought about the products and/or service offers you received.  Completing the mandatory feedback survey maintains your eligibility for future campaigns.

1.15 - The time limit for completing a mandatory feedback survey will be different for each campaign. It is for our Community members to be aware of the time limits in which they need to provide feedback for that campaign. Any Community member who does not fully complete the mandatory] feedback survey within the designated time limit for a campaign will have their membership with Triyit terminated immediately on the date following the deadline date. Triyit is not responsible or liable to any Community member who has their membership terminated on these grounds.

1.16 - Registering with Triyit does not guarantee that Community members will receive a Triyit Box. A Community member will only receive a Triyit Box if its Profile matches the consumer profile for the Brand Partner products or services which are to be included in the Triyit Box. The matching of Community member profiles with product campaigns is entirely at the discretion of Triyit.  For the avoidance of doubt even where a Community member profile is matched with a product campaign, Triyit Boxes are subject to the availability of corresponding Brand Partner products or services.

1.17 - Triyit Tokens can be earned by Community members for completing activities such as surveys and questionnaires on the Platform [or purchased through your account dashboard on the Platform].  Not all activities are rewarded with Triyit Tokens and the number of Triyit Tokens available may vary by activity based on the time it takes to complete, the complexity of the activity, or other factors.  If an activity awards Triyit Tokens on completion, it will state the number of Triyit Tokens awarded for completing it.  If you collect 20 Triyit Tokens, these will be redeemed automatically] to receive a Triyit Box.  Once redeemed, you will receive a Triyit Box that your Community member profile matches with, subject always to any restrictions on products stated in your Community member profile and availability of products.  Purchased Triyit Tokens are non-refundable other than with our express consent.

1.18 - Priority Points can be earned by Community members by completing optional surveys on the Platform, entering competitions with qualifying entries and engaging in additional activities.  If an activity offers Priority Points for properly completing it, the number of Priority Points earned for each activity will be shown on the relevant activity.  Once the relevant activity is fully completed, the Priority Points will be added to the Community member’s account automatically.  Community members can view the Priority Points they’ve earned on your account dashboard on the Platform.

1.19 - For each campaign, we will only be able to offer products to those Community members who match with all the Profile criteria that our Brand Partner is looking for.  Please note that all Triyit Boxes are limited to one per household.  If two or more Community member accounts are registered at the same address, only one Triyit Box will be issued to the relevant address if each Community member at that registered address qualifies for the same campaign.

1.20 - We offer free shipping anywhere within the mainland UK and Northern Ireland, but are unfortunately not able to offer our Services to those living on the Channel Islands, Isle of Man, remote locations or internationally outside of the mainland UK and Northern Ireland.

1.21 - We will only provide our Services to those Community members who adhere to our Code of Conduct and it is at our total discretion which of our Community members will receive products as part of our campaigns.

1.22 - We may make available on the user dashboard of the Platform various optional surveys offered by our Brand Partners and other third parties.  If we make these available you will be required to opt-in to these surveys in order to participate.  Eligibility to opt into such Brand Partner and/or third party surveys may be based on criteria determined by the third party offering the survey, and Triyit is not responsible or liable to any Community member who is not eligible to participate in such surveys due to their Profile or is otherwise not permitted to take part. These surveys may ask you questions about other members of your household and by answering these questions you represent that you have the consent of the other persons in your household to provide information to about them to us in response to these questions.

1.23 - We aim to make sure that our Services are provided in a consistent and uninterrupted manner. However, we cannot take any responsibility for events outside of our control. Our provisions regarding access to the Website and your access to it can be found at clause Error! Reference source not found..

1.24 - Before sending out campaign boxes to those Community members who have been selected to take part, We will require Community members to provide additional personal information. We will ask Community members to confirm their address, mobile phone number, and occasionally age verification or additional questions relevant to the campaign, which may further help in the matching process. The information collected during this 2nd stage process will be collected and handled in accordance with the terms of our Privacy Policy.

PRODUCT INFORMATION AND AVAILABILITY

1.25 - The listing of any particular product or service on our Website is for information and research purposes only.   Triyit does not warrant, make any representations, or guarantee the condition, quality or description in relation to any products or services you may receive as part of a Triyit product campaign.

1.26 - We are not responsible or liable for any loss or damage you or any third party may suffer or incur in connection with any product or service you receive after using this Website, the Platform and/or the Services or for any acts, omissions, errors or defaults of any third party in connection with that product or service.  Any defects in any products or services received through a Community member’s engagement with the Platform and/or through Triyit Boxes shall be the responsibility of the manufacturer of such products and/or provider of such services.  Triyit shall not be responsible for liable to a Community member for the same.

1.27 - Triyit Boxes are delivered by third party carriers.  Whilst we take all reasonable steps to ensure Triyit Boxes are correctly labelled, packed and delivered, we take no responsibility for any Triyit Boxes which are not properly labelled, delivered correctly or which contain damaged or missing goods once these have left our possession. We do not offer a returns or exchange option for any Triyit Box deliveries. Community members who have received products which have been damaged during their delivery are still bound by the Code of Conduct and are expected to submit feedback for that product.

1.28 - Whilst every effort is made to ensure the information provided on the Website is current, we have no responsibility or liability for any errors contained in the information. Inclusion of any product or service information on this Website is not an endorsement of any organisation, product or service.

1.29 - Triyit has the right, but not the obligation, to monitor any Content made available by any Community member on the Website and/or Platform.  Triyit reserves the right, in its absolute discretion, to block, modify or remove any Content contained on the Website and/or Platform without prior notice to any Community member, and will not be liable in any way for possible consequences of such actions.

1.30 - Triyit are not responsible for any adverse effects that results from a product you receive in a Triyit box. Further information can be found in section 1.72. 

1.31 - Any product, service, coupon or voucher offered by us, or any partners, is not intended for resale. Any violation (as determined solely by us) of this provision by a Community member may result in removal from the campaign and/or termination of your community membership without liability to you.

COMMUNICATIONS

1.32 - SERVICE COMMUNICATIONS

1.32.1 - In order to provide the Services to Community members, Triyit will send email and SMS messages to Community members to confirm selection for a campaign, to confirm delivery details, to remind them of important campaign activities, to complete any mandatory surveys, provide feedback, participate in SNAP–SHARE‑WIN activities, remind them of coupon expiry dates, promote available third party surveys and/or any other message which relates to the practicalities of the Triyit Services.

1.32.2 - By agreeing to these Terms, you are consenting to Triyit sending you these messages to fulfil our obligations under the Services.

1.33 - MARKETING COMMUNICATIONS

1.33.1 - As a result of the relationship between Triyit and our Brand Partners, from time to time, we may wish to send you messages with exclusive offers and discounts on the many products that your Profile indicates you’ll enjoy.

1.33.2 - We require your consent to send you such marketing messages and will ask if you wish to receive these when you sign up as a Community member. If you no longer wish to receive these marketing messages you can change your communications preferences at any time by clicking the “Unsubscribe” link at the bottom of our marketing emails or by contacting us directly using the contact information at clause 0 below.

COMPETITIONS

1.34 - From time to time, as part of a campaign, a competition will run in connection with that campaign. Entrants will be invited to post pictures on their relevant social media channels using the hashtags indicated by the information included with the campaign box to win prizes including supplies of the featured brand. For certain competitions, entrants may earn Priority Points for submitting entries for the competition, subject to the terms and conditions applicable to the relevant competition.

1.35 - Competitions are subject to the applicable Competition Terms as well as those stated in these Terms. Entrants must be at least 18 years of age or over and reside in the United Kingdom but may require to be older in order to participate in certain competitions where stated in the entry terms for the relevant competition. Entrants agree to participate in all reasonable promotional activities as requested by the Promoter unless otherwise notified to the contrary at the time of acceptance of the Prize. For more information on competitions and the terms and conditions applicable to each, including entry requirements, eligibility criteria, routes of entry and prize allocations please see the terms and conditions applicable to the relevant brand competition.

LINKS

1.36 - The Website may contain links to other websites.  Triyit provides those links as a ready reference for searching for third party goods and services on the internet and not as an endorsement of those websites, their operators, the goods, services or content that they describe.

1.37 - Other websites which are linked to the Triyit Website are not covered by these Terms, and may have their own terms and conditions and privacy policy.  If you choose to access these linked sites, this is done completely at your own risk.  Triyit is not responsible for and will not be liable in respect of the content or operation of any third party websites or any of the goods, services or content that they describe.   Triyit is not responsible for and will not be liable in respect of any incorrect link to an external web site.

1.38 - You are not permitted to frame or link the Triyit Website on any third party website or platform without first requesting and obtaining express written permission from Triyit.

ACCESS

1.39 - Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit does not represent or warrant that you will have continuous access to the Website and/or Platform or that the Website and/or Platform will be free from viruses or other harmful components. Triyit will not be liable in the event that your use of this Website and/or the Platform is disrupted or prevented due to computer downtime attributable to malfunctions, upgrades, preventative or remedial maintenance activities or interruption in the supply of telecommunications. Triyit does not guarantee that any such technical issues that might arise can be resolved quickly. 

1.40 - Triyit does not guarantee the delivery of communications over the internet as such communications are reliant on services provided by third parties.  By using the Website and/or Platform you acknowledge that the use of the same is subject to limitations and risks inherent in such forms of communication or media used to make these available.  Electronic communication (including electronic mail) is vulnerable to interception by third parties and Triyit does not guarantee either the security or the confidentiality of these communications or the security of the Website and/or Platform.

1.41 - Triyit does not provide, and has no control over, communications, networks or services, the internet or other technology required or used across the Website and accepts no responsibility for any direct or indirect loss in any form associated with them, whether due to congestion, technical malfunction, viruses or any other circumstances.

1.42 - Information contained on the Website relating to goods and services has been prepared in accordance with UK law and may not satisfy the laws of another country. Triyit does not warrant that the goods or services made available through the Website and/or the Platform or that the Website the Platform or any Content comply with the laws of any other country.  You are responsible for determining whether or not the goods or services comply with the specific laws of your jurisdiction.

1.43 - Those who access and/or use this Website or its Content from outside of the UK or who transact on this Website, do so at their own risk.  Triyit shall not be responsible or liable to any user or third party as a result of any access of the Website and/or Platform taking place outside of the UK.

PRIVACY AND DATA USE

1.44 - Any Personal Data which you submit to Triyit is subject to and will be handled in accordance with Triyit’s Privacy Policy.  The Privacy Policy forms part of these Terms and is hereby incorporated by reference.  You agree that, by using the Website or communicating with Triyit, you are also confirming that you have read the Privacy Policy, understood its contents and consent to its requirements.

1.45 - For the purposes of these Terms, “Non-Identifying Information” means Personal Data which has been processed to remove any information which could identify individuals.

1.46 - Triyit sometimes has to share user data provided via the Website or Platform with persons who provide a third party service to Triyit in connection with the Website, Platform and/or Services.  By using the Website and/or Platform you consent to Triyit making use of and sharing such data for these purposes.  Any data shared will be done so in a manner consistent with our Privacy Policy.

1.47 - By registering as a Community member and/or using our Platform and Services, you expressly consent to the licensing and/or sale of Non-Identifying Information derived from your use of the Platform to third parties.  Any Non-Identifying Information licensed and/or sold will only be done so for lawful purposes including but not limited to analytics, research and consumer trend research and our licensing and/or sale and/or use of the same shall be in a manner consistent with our Privacy Policy.

1.48 - Triyit shall not be responsible or liable for the use or handling of Non-Identifying Information by third parties who have lawfully acquired the same from us where this is used in connection with a purpose for which the relevant Non-Identifying Information was not originally shared.  If third parties use such Non-Identifying Information in any manner which can cause or causes an individual to be identified in breach of Data Protection Laws, all responsibility and liability in respect thereof shall lie with the relevant third party.

1.49 - From time to time, Triyit may contact Community members with offers to connect Community members with Brand Partners and/or other third parties through email or via the Platform for promotional or incentive opportunities offered by or on behalf of such third parties.  If you wish to be connected with such third parties, this may require Triyit to share certain non-anonymised Personal Data such as your name and email address with the relevant third party.  Any sharing of non-anonymised Personal Data in this manner will be on a case-by-case basis and requires your consent as to the Personal Data that is to be shared.  Triyit will not share Personal Data under this clause without your consent.

1.50 - From time to time, Triyit may offer surveys on behalf of third parties to be completed on the Platform by Community members.  You will require to opt into such surveys in order to participate.  If you opt in to such third party surveys, you consent to Triyit sharing Non-Identifying Information to such third parties for the purposes of providing insights and analytics to third parties in connection with such surveys.

1.51 - Each action you take on the Platform (e.g. clicking buttons or links, submitting product reviews) will be recorded.  The recorded information will be used for a variety of purposes, including but not limited to investigating issues with the Platform, analysing our services and/or making improvements to the Platform.  We do not treat the information recorded in such logs as Personal Data (other than to the extent require under Data Protection Laws) but if we combine it with any Personal Data it will be treated as Personal Data and handled in accordance with our Privacy Policy.

1.52 - By using the Website and/or Platform, you consent to us taking data derived from your use of the Platform and using this in conjunction with publicly available third-party data sources for the purposes of analysing wider information for providing our Services.

1.53 - Personal Data may be processed using automated processing means.  Such automated processing is mainly for the purposes of following a procedure on the Platform, though automated processing of Personal Data may be used in decision-making processes regarding a Community member’s suitability and eligibility for campaigns, surveys and offers made available on the Platform.  If you object to the use of automated processing of your Personal Data for decision-making in this manner, please contact us at help@triyit.co.uk.

INTELLECTUAL PROPERTY RIGHTS

1.54 - All Intellectual Property Rights in the Website and Platform, Triyit’s goods and Services, and all components of them are owned by or licensed by third party licensors to Triyit and/or any of its related entities.   Copying, modifying or transmitting any part of the Website or Platform is not permitted without our consent or the consent of our third party licensors (where applicable).

1.55 - The Website, Platform and Content contain Intellectual Property Rights including but not limited to trademarks, logos, service names, trade names of Triyit which may be registered or otherwise protected under the law.  You are not permitted to use, nor does your use of the Platform give you any rights in, any of these trademarks, logos, service names, trade names or any other content or copies of the Content appearing on the Website or Platform.

1.56 - You shall indemnify Triyit against any third party claims, losses, actions or expenses that may be brought against Triyit in connection with your unauthorised use of any Intellectual Property Rights of any third party on or in connection with your use of the Website or Platform or for Content you submit to the Website or to third party platforms in relation to any competition made available to you by Triyit or its Brand Partners.

1.57 - By making Content available on the Website and/or Platform or any third party sites as part of a Triyit campaign, promotion or competition, you represent that you own or have the right to use all of the content and information you post. Although you will continue to own your Content (unless stated otherwise in the terms of any third party site used), when you publish Content as described, you agree that you are allowing us and our clients to access and use that content and/or information.

1.58 - For Content that is covered by intellectual property rights (like photos and videos) you grant us a non-exclusive, sub-licensable, royalty-free, perpetual, worldwide licence to use this content in connection with current and future Triyit campaigns/marketing and our Brand Partners’ own marketing communications. For example, our client could create an ad using content that you have placed/posted as part of a Triyit campaign, promotion or competition. You waive any right to compensation or reimbursement of any kind from us or any of our Brand Partners or third party service providers for the use of the same under any circumstances nor shall there require to be any acknowledgement or reference to your authorship of such content and you waive any moral right to exercise any moral rights in respect of such content.

WEBSITE AND PLATFORM LICENCE AND USE

1.59 - Subject to your compliance with these Terms and the Code of Conduct, Triyit grants you a non-exclusive and non-transferable licence to use the Website and Platform for your own personal use, subject to the restrictions specified in clause 0 below.   You are not authorised to download (other than page caching) or modify the Website or Platform or any portion of the Website or Platform. You agree that any Content which you choose to post on the Website, Platform or otherwise provide or communicate to Triyit, will be treated as non-confidential and non-proprietary information.

1.60 - Triyit reserves the right to make changes and/or updates to the Website or Platform at any time without prior notice. 

PROHIBITED USES

1.61 - Except as otherwise expressly permitted under these Terms, in using the Website or the Platform you must not:

1.61.1 - Engage in any commercial activity including marketing, advertising or commercial promotion of goods or services, resale, collect or use any product lists or information for the benefit of other merchants, data mine or use robots or other data collection methods;

1.61.2 - Impersonate or falsely claim to be a representative of a person or organisation;

1.61.3 - Defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including without limitation, rights associated with privacy and publicity;

1.61.4 - Post, link to, or otherwise communicate or distribute any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material, content or information, or otherwise use the Website in a manner which is unlawful or would infringe on the rights of another person including any intellectual property rights;

1.61.5 - Post, link to, or otherwise distribute any information, material or item which contains a virus, trojan horse, worm or other harmful or disruptive component.

1.62 - Unauthorised use of the Website or Platform may give rise to a claim for damages and/or may result in legal proceedings being taken against you.  If a third party gains unauthorised access to your login details, you are still responsible for all activity undertaken on your account, regardless of whether such activity is by you or a third party.

1.63 - Triyit provides no warranties and cannot guarantee that any file, program, access or use of the Website or Platform is free from viruses, malware or other harmful technology or material which could damage or infect your data, hardware, software or other equipment. By accessing and using the Website or Platform you assume all risk in this regard and you release Triyit Ltd from all applicable liability and responsibility.

TERMINATION

1.64 - Triyit may at any time immediately terminate your access (including restricting access) to the Website, Platform or any feature of either of the foregoing for any reason (including due to your breach or alleged breach of these Terms or the Code of Conduct) in its sole discretion and without prior notice.  Any indemnities given by you and any limitations of our liability survive such termination indefinitely. 

1.65 - You may terminate your participation as a Community member of Triyit at any time, for any reason, by sending an email to: help@triyit.co.uk with the subject heading ‘Leave the platform’. Please also give your name and contact number to allow us to verify your decision to terminate your account.  We will make reasonable efforts to contact you and verify your request to cancel your account however if no response is received, we will terminate your account within 7 days of receiving the request.

1.66 - If you choose to terminate your membership after receiving a Triyit Box and without having submitted your campaign feedback, your details and account will be blacklisted, meaning you will not be able to re-join the platform in the future. Furthermore, no one else living at the same address will be able to register as a Community member.

1.67 - Our agreement with you under these Terms is in full force and effect while you visit the Website or the Platform and/or are a Community member of Triyit and continues to be so even after your participation ends or is terminated.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

1.68 - To the full extent permitted by law, Triyit excludes all warranties, whether express or implied, including any warranties or representations concerning availability of the Website or Platform, quality, completeness, accuracy, suitability, acceptability or fitness for purpose in relation to the Website, the Platform, the Content, the conduct of any users, all links to or from the Website and the goods and services listed or made available through the Website or the Platform.

1.69 - Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit excludes all liability for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with these Terms, the Website, the Content, and all links to or from the Website.

1.70 - Subject to the consumer guarantees provided for in UK consumer protection legislation, Triyit excludes all liability for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with the goods and services listed, accessible or made available on or through the Website, Platform or Services.

1.71 - Triyit Community members and site users are subject to our Code of Conduct at all times.

1.72 - Triyit shall not be held liable for any injury, loss or damage as a result of any receipt, use or misuse of a Product or allergic reaction which a Community member might suffer as a result of a Product supplied as part of a campaign. It is for Community members to be aware of the contents of campaign Products and to take the necessary precautions to ensure that they are safe and that Products are used in a safe and sensible manner.  Community members are responsible for ensuring that any allergies, dietary restrictions, religious restrictions, medical restrictions, or any other restrictions which may apply to them relating to their receipt or use of goods or services made available through the Platform are recorded in their Profile to ensure that the relevant Community member is not offered to participate in campaigns which are not compatible with any such personal restrictions.

1.73 - In no event will Triyit or any of its officers, employees or representatives be liable to any user of the Website or Platform for any indirect, consequential or special losses, losses that were not foreseeable to you and us, losses that were not caused by any breach on our part, business losses or losses to non-consumers.  This limitation of liability does not apply to death or personal injury caused by negligence, fraud or fraudulent misrepresentation or for any other liabilities which cannot be limited or excluded by applicable law.

INDEMNITY

1.74 - You agree to fully indemnify Triyit, its directors, officers, directors, employees, consultants, agents and affiliates in respect of all, costs, expenses (including legal fees on a full indemnity basis), losses, damages, fines, penalties, claims, demands and proceedings howsoever  arising, whether at common law (including negligence) or under statute, in connection with any of the following:

1.74.1 - Any breach of these Terms by you;

1.74.2 - Your access or use of the Website or Platform;

1.74.3 - Infringement of any third party’s Intellectual property Rights through Content you post or make available through the Website or Platform;

1.74.4 - Any products delivered in a Triyit Box or otherwise; or

1.74.5 - Your communications with Triyit or any other third party.

JURISDICTION AND LAW

These Terms are governed by and must be construed in accordance with the laws of Scotland.  Any action, claim, proceeding or dispute arising in connection with these Terms, the Services, the Website and/or the Platform, their performance, and their interpretation shall be subject to the exclusive jurisdiction of the Scottish Courts.

WAIVER

If you breach these conditions at any time and we decide to take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

SEVERABILITY

Each provision of these Terms is severable from the others and no severance of a provision will affect any other provision.

ENTIRE AGREEMENT

These Terms constitute the entire agreement of the parties relating to its subject matter and supersede any and all preceding and contemporaneous agreements between you and Triyit. Any waiver of any provision of the Terms will be effective only if obtained in writing and signed by a Director of Triyit Ltd.

1.2 - We have provided this Privacy Policy to inform you ("you" or "your") how we gather and use, and the circumstances under which we may disclose, personal data we collect from our members ("Community Members") through www.triyit.co.uk (the "Website") and/or in in connection with our online product discovery platform service and competitions and contests we run (the "Service").  For these purposes “personal data” is any information relating to an identified or identifiable individual.

1.3 - The owner of the Website is Triyit Ltd.  We act as the data controller in regards to the personal data you provide through your use of the Website (a data controller is responsible for determining why your data is collected and how it is processed.) 2.1 - Under the UK General Data Protection Regulation (“UK GDPR”), you have the following rights in regards to your personal data, which we will always work to uphold:

2.1.1 - The right to be informed about our collection and use of your personal data. This Privacy Policy should tell you everything you need to know, but you can always contact us to find out more or to ask any questions using the details in Part 15.

2.1.2 - The right to access the personal data we hold about you. Part 11 will tell you how to do this.

3 - PRIVACY POLICY IS LIMITED TO TRIYIT

This Privacy Policy does not apply to third party sites to which we may link or to the products or services of our business partners such as the brands that we work with who provide product samples or third parties who may host and/or deliver our data to brands and other like services. The fact that we link to a website or display an advertisement or other third party content is not an endorsement, authorisation or representation of our affiliation with any of those third parties, nor is it an endorsement of their privacy or information security policies or practices.  Any access to such third party sites will be subject to their own privacy policy in regards to personal data which they may store and use.

4 - COLLECTION AND USE OF NON-IDENTIFYING INFORMATION

4.1 - We may collect, use, transfer, and disclose information in a form that does not personally identify you or any person on whose behalf you have provided to us their personal data ("Non-Identifying Information") for any purpose. Non-Identifying Information can include certain personally identifiable information that has been de-identified; that is, information that has been rendered anonymous. We and/or our third party service providers obtain and may collect Non-Identifying Information about you from information that you provide us and/or from your use of the Service, either separately or together with your personal data. We may combine your personal data with Non-Identifying Information and aggregate it with information collected from other users or sources (including publicly-available sources) to attempt to provide you with a better experience, to improve the quality and value of our products and services, and to analyse and understand how our products and services are used. We may also use the combined information without aggregating it to serve you specifically.  We may license or sell Non-Identifying Information derived from your personal data to third parties but under no circumstances will any such Non-Identifying Information so licensed or sold include any data which may identify you.

4.2 - When you access our Service, we and our third-party service providers may use a variety of technologies, now and hereafter devised, that automatically record certain usage information. This information may include your Internet Protocol address (and other unique identifiers for the particular device you use to access the Internet), browser type, your web or application request, your interaction with our Service, the webpage or other feature you were using before you came to our Service, pages of our websites that you visit, information you search for via our Service, access times and dates, and other similar information. We use this information for a variety of purposes, including analysing and enhancing our products and services, and to help personalise our Service for you. 5 - COLLECTION OF PERSONAL DATA

5.1 - As part of your use of our Website and as part of our Service to the brands we work with, we may ask you to submit feedback on certain products, by way of surveys, testimonials, ratings and reviews or other format. In the course of using our Website and participating in our Service, we may collect the following personal data from you:

5.1.1 - Your name;

5.1.2 - Address;

5.1.3 - Phone number;

5.1.4 - E-mail address;

5.1.5 - Age;

5.1.6 - Gender;

5.1.8 - Information from third party social media platforms you choose to link to our Website;

Some of the personal data above has to be provided to enable us to deliver our Service to you.  For other personal data, we may ask if you want to give us certain personal Information and let us use it for the purposes we request it for.  Where this is the case we will tell you and give you the choice to share the personal data with us.  We will also tell you whether declining to share that personal data will have any effect on your use of our Website or the Service offered through it.  Certain surveys undertaken on the Website may also ask for personal data relating to other members of your household.  By sharing this information with us you are deemed as confirming to us that you have the consent of the relevant person to whom such personal data relates to share this with us.  We will not share identifiable personal data you provide on any third party’s behalf but may process this into Non-Identifying Information for sharing with third parties.

5.2 - Our justification for collecting this personal data is that it is necessary for us to do so in order to fulfil our obligations to our Members under the contract between us contained in our Terms and Conditions. We may also collect personal data on the basis that we have a legitimate interest in doing so, where this does not override your own rights and interests.  Such personal data may be collected for the purposes of data analytics.

5.3 - If you decide to access our Service or sign up via a third party social networking platform ("SNP"), such as Meta, via our Service, we may also collect personal data when you interact with the applicable SNP’s service. If you log into an SNP via the Service, you are allowing Triyit to access the personal data in your SNP account, as well as other information associated with your SNP account, pursuant to the SNP's applicable terms and conditions. The information we receive from an SNP may depend on the privacy settings you have with the SNP, so please check the SNP's privacy policy.

5.4 - We may also collect personal data from third party services which we use in connection with the Service.  We collect personal data from third parties form the following sources:

5.4.1 - Google – if you log in to your Triyit account using Google OAuth, we may collect your name, email address and contact details associated with your Google account as well as the permissions you grant to us by logging in using Google OAuth.

5.4.2 - Meta – We utilise Meta Pixel to help us understand our advertising on the across the Meta network and to provide you with relevant, targeted adverts. The Meta Pixel enables us to collect information about your browsing behaviour on our website, which may be shared with Meta to allow us to show you content and adverts across Meta platforms that are more relevant to you.  You may adjust or disable the Meta Pixel through your browser settings or Meta’s advert preferences.

5.5 - For information on how long we keep your personal data, see clause 7 below.

6 - USE OF PERSONAL DATA

6.1 - We may use your personal data, either alone or in combination with other information, so that we can provide, enhance and personalise our Service and related content, products, offers, and marketing efforts. The following is a non-exhaustive list of ways that we may use your personal data:

6.1.1 - To register and/or identify you as a user of the Service and to help authenticate any account you create with us;

6.1.2 - To match you with products, offers, and trials that best fit your likes and needs;

6.1.3 - To send you products or samples as part of a Triyit campaign or to winners of a competition administered by us;

6.1.4 - To communicate with you regarding product campaigns, the Service, updates, offers, promotions or events and to deliver products to you for sampling (if you have provided your consent for us to use your information in this way);

6.1.5 - To help us develop, customise, deliver, support and improve our Service, products, samples, content, and advertising and to provide you with the best user experience possible;

6.1.6 - To administer promotions, contests, competitions, or other offerings;

6.1.7 - To protect the rights or property or security of Triyit or our users, and prevent fraud and other prohibited or illegal activities;

6.1.8 - To process your personal data into Non-Identifying Information;

6.1.9 - For data analysis to gain insight into consumer product trends for our own or for our third party customers’ benefit;

6.1.10 - For our internal purposes (such as auditing, data analysis, and research to improve our services, and communications); and

6.1.11 - As may be disclosed to you at the point of collection.

6.2 - Special Category Personal Data may be processed in connection with specific purposes not listed above.  Such uses may include (but are not necessarily limited to) recording any restrictions which may impact on products or services offered through the Website or Service, for example, due to your religious or other beliefs.

6.3 - We may provide certain Non-Identifying Information to our third party customers for the purposes of offering third party surveys to our registered users through the Website.  This will be on an opt-in basis for users to provide their consent to having their Non-Identifying Information shared for the purposes of the relevant survey.

6.4 - Except as described in this Privacy Policy we will not share your identifiable personal data with other companies or individuals outside of Triyit and its affiliates, unless we have received your consent. For example, we will ask for your consent to share your identifiable personal data with certain third parties including but not limited to third parties who undertake data aggregation on our behalf, our brand partners relating to your feedback on their goods and services, and other third parties.  

7 - STORAGE OF PERSONAL DATA

7.1 - We will not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. Your personal data will therefore be kept for the following periods (or, where there is no fixed period, the following factors will be used to determine how long it is kept):

If you withdraw an account you create on our Website, after the retention period expires we will anonymise any personal data and retain the Non-Identifying Information for analytics purposes, following which we will delete your identifiable personal data.  Please note that the retention periods above apply only to personal data which contains identifiable information and does not apply to any Non-Identifying Information, which will be retained in accordance with our internal data retention policy.  We may also periodically review the personal data we retain and delete your identifiable personal data prior to the retention periods stated above expiring, if we no longer have a reason to continue retaining it.

7.2 - We will only store or transfer your personal data within the UK and the European Economic Area (the “EEA”). The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein. This means that your personal data will be fully protected under the UK GDPR or to equivalent standards by law. By supplying your Personal data to Triyit, you are consenting to Triyit passing your information outside of the EEA. Wherever your personal information is transferred, stored or processed by us, we will take reasonable steps to safeguard the privacy of your personal information. These steps may include implementing standard contractual clauses where recognized by law, obtaining your consent, or other lawful means of transferring personal data.

7.3 - The security of your personal data is essential to us, and to protect your data, we take a number of important measures, including the following:

7.3.1 - Personal data may be transmitted over secure networks only, transmission over unsecured networks is not permitted in any circumstances;

7.3.2 - Personal data may not be transmitted over a wireless network if there is a wired alternative that is reasonably practicable;

7.3.3 - Personal data contained in the body of an email, whether sent or received, should be copied from the body of that email and stored securely. The email itself should be deleted. All temporary files associated therewith should also be deleted using permanent deletion of the email from trash;

7.3.4 - Special Category Data will be stored or transferred by encrypted means;

7.3.5 - Where personal data is to be transferred in hardcopy form it should be passed directly to the recipient; and

7.3.6 - All personal data to be transferred physically, whether in hardcopy form or on removable electronic media shall be transferred in a suitable container marked “confidential”.

8 - SHARING CAMPAIGN FEEDBACK & OTHER CONTENT

8.1 - The information collected during the feedback/survey process is used to prepare statistical reports and analytics for our clients (also known as our “Brand Partners”). The reports give insight into the performance of the product during a campaign run on a Brand Partner’s behalf. The reports will not contain your personal data, unless you have specifically given permission for this to be included via an opt-in at the time you join a campaign or leave feedback.  Under the UK GDPR we may share Non-Identifying Information with Brand Partners for these purposes.

8.2 - By creating an account for the Service, you acknowledge and agree that: (a) we are not under any obligation of confidentiality (express or implied) with respect to your campaign/product feedback; (b) we and our clients can use or disclose (or choose not to use or disclose) your feedback for any purpose, in any way, in any media worldwide; and (c) you are not entitled to any compensation or reimbursement of any kind from us or any of our clients under any circumstances.

8.3 - By posting content to our Website or any third party sites as part of a Triyit campaign, promotion or competition, you represent that you own or have the right to use all of the content and information you post. Although you will continue to own your content (unless stated otherwise in the terms of any third party site used), when you publish content as described, you agree that you are allowing us and our clients to access and use that content & information. For content that is covered by intellectual property rights (like photos and videos) you grant us a non-exclusive, sub-licensable, royalty-free, worldwide license to use this content in connection with current & future Triyit campaigns/marketing and our Brand Partners’ own marketing communications. For example, our client could create an ad using content that you have placed/posted as part of a Triyit campaign, promotion or competition. You are not entitled to any compensation or reimbursement of any kind from us or our Brand Partners for any use of such content under any circumstances.

8.4 - You, and not us, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via Triyit and/or any of our product campaigns.  We will handle any personal data provided in accordance with this Privacy Policy but you are responsible for disclosing the same.

8.5 - We do not have an obligation to review the content posted to our site, but you understand that we may refuse to post or remove any of your content at our sole discretion.

9 - OUR SERVICE PROVIDERS

9.1 - We may engage third parties to perform services on our behalf, such as hosting and storage services, software maintenance services, e-mail notifications, database management, analytics and other services. These third parties may have access to your personal data to perform certain tasks on our behalf but they are not authorised by us to otherwise use or disclose your personal data.  We only allow these organisations to handle your personal data if we are satisfied they take appropriate measures to protect your personal data. 

9.2 - In addition, if you voluntarily participate in a contest, competition, rewards program or other promotion through our Website or Service, we may share your personal data  with the participating sponsors or with third parties who assist us in using the content or other information you have posted or shared with us for the purposes of assessing eligibility for promotion or for determining contest winners, or for making prizes available to winning entrants.  By entering into these competitions, rewards programs and promotions you accept that we may share personal data with these third parties for these purposes.

9.3 - The service providers we are currently engaged with and to whom we transfer personal data are:

9.3.1 - Google Cloud Platform – Cloud storage platform for all profiles and member data.

9.3.2 - DPD (DPDGroupUK Limited) – are provided with community member’s names and addresses to facilitate package delivery. 

9.3.3 - EVRI (EVRI LIMITED) – are provided with community member’s names and addresses to facilitate package delivery. 

9.3.4 - Royal Mail – are provided with community member’s names and addresses to facilitate package delivery.

9.3.5 - Amazon Web Services (AWS) –we use AWS to securely store certain information received in connection with the Service, which may include your personal data.  This includes your responses to surveys and personal details used to undertake matchmaking for a Triyit campaign and to store feedback on products received as part of Triyit campaign.  This also includes survey responses and personal details provided in connection with a competition, context or giveaway.

9.4 - If you participate in a sweepstakes, contest, rewards program or other promotion through our Service, we may share your personal data with the participating sponsors or with third parties who assist us in using the content or other information you have posted or shared with us.

10 - OTHER GENERAL INFORMATION

10.1 - Public Posts on the Service

Any information that you disclose to publicly accessible areas of the Website or to the Service is at your own risk and may be seen or collected by other persons, including third parties that may not adhere to the standards set forth in this Privacy Policy. Do not submit information, comments, or other content that you want to keep strictly private. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Website or Service.

10.2 - Changing or Deleting Your Information

To view and change personal data such as your name, address and contact details that you have directly provided to Triyit via the Service, you can contact Triyit by sending an email to help@triyit.co.uk.  Information may also be accessible via the "account profile" section of our Website. Please note we may retain server/backup copies of all such data for compliance with our legal obligations or for statistical analysis purposes where the erasure of the same is likely to render such activity impossible, and that we may decline to process change or deletion requests that we deem to be unreasonable, or require disproportionate technical effort, or jeopardise the privacy of others.

10.3 - Compliance with Laws, Legal Process and Authorities

We may disclose personal data or other information about you to government or law enforcement officials, in connection with court orders or  judicial process, to protect the property and rights of us or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable.

10.4 - Business Transfers

We reserve the right to transfer or otherwise disclose your personal data in connection with a merger, acquisition, or other change in control, joint venture, reorganisation or sale of assets or in the event of bankruptcy or liquidation proceeding.

10.5 - Data Transfers

Triyit processes personal data via 3rd party service providers. Your personal data may be transferred to, and used by, entities located outside of your country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Such export is a requirement of providing your information to Triyit, and you consent to such transfer and use in all respects.

10.6 - Our Policy Toward Children

We do not knowingly collect personally identifiable information from anyone under 18 and do not target our online services to anyone under 18. If we discover that someone under the age of 18 has provided personal data we will delete such information from our Website and server. We encourage parental controls to prevent children from submitting information or data on our Website.

11 - HOW CAN YOU ACCESS YOUR PERSONAL DATA?

11.1 - If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.

11.2 - All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 15.

11.3 - There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

11.4 - We will respond to your subject access request within 28 days and, in any case, not more than one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

12 - RIGHT TO RECTIFICATION

In accordance with the rights indicated in Part 2, you have the right to request that any of your personal data which we hold and which is or has become inaccurate, be changed to reflect your correct information. Most of this information can be managed yourself using the settings of your community member account, however if this is unavailable or the request relates to information which isn’t part of your profile, please write to us at the address in Part 1, or email us at the email address in Part 15 with the details of your request.

13 - SECURITY IS IMPORTANT TO US

We strive to protect your personal data and privacy. We employ security measures to protect your personal data from unauthorised access and disclosure. Our service providers use secure sockets layer ("SSL") technology. An SSL certificate is a digital certificate that authenticates the identity of a website and encrypts information sent to the server. 14.2 - Non-Identifying Information may be provided to third parties for marketing, advertising, for analytics purposes by Non-Identifying Information with information available from publicly accessible data, or other uses. For example, we may share aggregated demographic data about our members without disclosing personal data except as described in this Privacy Policy.  If we combine Non-Identifying Information with third party data which enables an individual to be identified, the information will be treated as personal data and handled in accordance with this Privacy Policy. 

15 - OPT-OUT AND CONTACT INFORMATION

If you decide at any time that you no longer wish to receive communications from us, please follow our unsubscribe instructions on one of our email communications, update your marketing communication preferences on your account dashboard or email us at help@triyit.co.uk . While you are a member of Triyit you may not opt-out of important communications from us such as service related announcements or notifications about changes to our Terms and Conditions or Privacy Policy.
